An Ordinance for the regulation of Chinese Pass- enger Ships on voyages of not more than seven days duration.

WHEREAS, by section 2 of the Chinese Passengers

Act, 1855, (18 and 19 Viet, e. 104) it was provided that it should be lawful for the Legislature of Hongkong, by any Ordinance to be by them enacted for that purpose, to make regulations respecting Chinese passenger ships and, in the case of British ships, respecting the treatment of the passengers therein while at sea, and that until such enactment the regulations contained in sebedule (4) to that Act annexed should be in force, Provided always that no such Ordinance should come into operation until Her Majesty's confirmation of the same should have been pro- claimed in Hongkong by the Governor thereof: And, whereas, by The Chinese Emigration Consolidation Ordi- nance, 1889, (No. 1 of 1889) as amended by Ordinance No. 25 of 1889, regulations under the said Chinese Pus- sengers Act, 1855, respecting Chinese passenger ships (as in such Ordinances defined) proceeding on a voyage of more than seven days' duration were duly made by such Legislature, and Her Majesty's confirmation of the said Ordinance was duly proclaimed in Hongkong by the Gov- ernor thereof:

And whereas it is expedient to make regulations for Chinese passenger ships proceeding on a royage of not more than seven days' duration:

Be it enacted by the Govenor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as The Chinese Pas- angers (short voyages) Ordinance, 1896.

2. In the interpretation of this Ordinance-

The term Chinese Passenger Ship shall include every ship carrying from any port in Hongkong and any British ship carrying from any port in China or within one hundred miles of the coust thereof more than twenty passengers being natives of Asia. The word Ship shall include all son-going vessels. The term Emigration Officer shall include every person lawfully acting as Emigration Officer, and shall include any person deputed or authorized by the Emigration Officer to execute any power or per- form any duty vested in or imposed upon him by this Ordinance.

In all ports and places where no Emigration Officer shall have been appointed, the British Consul shall, until such appointment and at all times pending the vacancy of such office, be deemed to be the Emigration Officer for the pur- pose of this Ordinance.

The term British Consul shall include any person law- fully exercising Consular authority on behalf of Her Majesty in any foreign port.

The term licensing Officer shall mean the Governor in Hongkong, and elsewhere the Emigration Officer. The term Master of any Ship shall include any person for the time being in command or charge of the

same.

The term Short Voyage shall mean a voyage of not more than seven days' duration and shall includo any voyage which, in pursuance of the third section of the Chinese Passengers Act, 1855, is for the time being declared to be a voyage of not more than seven days' duration and shall also include a River Voyage, a Cousting Voyage, an Ocean Voyage (23) and an Ocean Voyage (B) as

hereinafter defined.

The term liver Voyage shall mean a voyage of not more than seven days' duration on Rivers or Lakes without going into rough waters.

The term Coasting Voyage shall mean a voyage not exceeding 250 miles on the Coast of China or between China and Formosa.

The term Ocean Voyage (4) shall mean a voyage at

The terni Ocean Voyage (B) shall mean a voyage exceeding 650 miles at sea but of not more thau 7 days' duration.
